What would be the outcome of a reckless driving ticket in Virginia with a clean driving record?
I received a reckless driving ticket for passing a car going 45 mph in a 55 moh zone. It was a one lane road and I crossed the dotted line to pass, pushed my quick acceleration button and passed going 76 mph. After passing I went back to the speed limit of 55 mph. I have a clean record except I had a speeding ticket dropped for driving school back in December. What will happen?
Reckless driving is a Class 1 Misdemeanor criminal offense that can and does result in jail time in some cases. In Virginia, it is just as serious as a DUI. It's worth consulting with a lawyer who handles these cases in whatever court you are charged.
It is hard to predict what will happen, it really depends on the judge you get, and exactly what it says in any police report. You might be fine, but some judges routinely toss people in jail for reckless driving for a night or two.
There is certainly a reasonable chance to get it reduced to a non-criminal offense. But your chance is probably better if you have a lawyer represent you.
Having a (mostly) clean driving record is a definite plus.
